Host Will Kacy drills into the objection opponents reach for first: Texas v. White, the 1869 Supreme Court case they hold up as an irrefutable, case-closed bulwark against independence. Kacy puts it in context. The ruling came down just after the Civil War, written by Chief Justice Salmon P. Chase, and the Court that issued it is the same institution that once blessed slave-catching and segregation before those decisions were overturned. Texas v. White, he argues, settles far less than its boosters claim.
